Defining the Crime of Date Rape
Date rape, or rape that occurs between people who know each other, is charged like any other rape under the crime of criminal sexual assault. Under 720 ILCS 5/11-1.20, a person is guilty of criminal sexual assault if an act of sexual penetration is committed and the person:
- threatens or uses force;
- knows that the victim is unable to provide knowing consent or to understand the nature of the act;
- is a family member of the victim and the victim is under the age of 18; or
- is 17 or older and has a position of trust, supervision, or authority in relation to the victim and the victim is between the ages of 13 and 18.
The crime becomes aggravated under 720 ILCS 5/11-1.30 if, among other factors, the person displays or threatens to use a dangerous weapon, causes bodily harm to the victim, the victim is physically handicapped, the person delivers a controlled substance to the victim without the victim’s consent or by threat or deception, or the person is armed with a firearm.
